- "Services" refers collectively to the NSVPL website, MConnect platform, OutfitFashion brand, and all associated products, features, and content.
- "User," "You," "Your" refers to the individual or entity accessing or using our Services.
- "MConnect" refers to our marketing automation and WhatsApp Business communication platform.
- "OutfitFashion" refers to our fashion and apparel brand.
- "Content" includes text, images, videos, designs, logos, software, and any other materials provided through our Services.

By accessing or using any part of our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. We reserve the right to update these Terms at any time. Continued use after changes constitutes acceptance of the new Terms.

5. MConnect — WhatsApp Business Platform
5.1 Service Description
MConnect provides marketing automation and WhatsApp Business API integration services. Our platform enables businesses to send WhatsApp messages, manage customer conversations, automate marketing campaigns, and access analytics — all through the official WhatsApp Business API.
5.2 Compliance with Meta Policies
Users of MConnect agree to comply with all applicable Meta Platform Terms, WhatsApp Business API Terms, Meta's Community Standards, and WhatsApp Commerce Policies. Violation of any of these policies may result in immediate suspension or termination of MConnect services without notice.
We reserve the right to audit MConnect usage for compliance with Meta policies at any time. Users must cooperate fully with such audits.
5.3 Opt-In Consent Requirement
Before sending any WhatsApp messages through MConnect, you must:
- Obtain explicit opt-in consent from each recipient to receive messages via WhatsApp
- Clearly inform recipients about the type and frequency of messages they will receive
- Maintain records of opt-in consent for the duration of your use of MConnect
- Provide a clear and functional opt-out mechanism in every message sent
- Immediately honor any opt-out or unsubscribe request from a recipient
- Not send messages to any user who has previously opted out
Failure to comply with opt-in and opt-out requirements is a violation of both these Terms and Meta's WhatsApp Business API Terms.
5.4 Prohibited Uses
When using MConnect, you agree NOT to:
- Send unsolicited messages or spam in any form
- Share or distribute illegal, harmful, threatening, abusive, or offensive content
- Use the platform for fraudulent, deceptive, or misleading purposes
- Violate any applicable laws, regulations, or Meta's policies
- Infringe on the intellectual property, privacy, or other rights of others
- Attempt to bypass, interfere with, or reverse-engineer platform security measures
- Use MConnect to send messages outside the approved WhatsApp Business API use cases
- Share or transfer MConnect access to unauthorized third parties
5.5 Message Templates & Content
All WhatsApp message templates submitted through MConnect must comply with Meta's template approval and quality standards. We reserve the right to reject, remove, or request modification of templates that violate any applicable policies. Marketing messages sent through MConnect must include clear identification of the sender business.
5.6 User Data & Privacy
MConnect users are responsible for ensuring compliance with all applicable data protection laws when collecting, storing, and processing their end customers' personal data. You agree that:
- You have a lawful basis for processing your end customers' data
- You have provided adequate privacy notices to your end customers
- You will not use MConnect to process sensitive personal data without explicit consent
- You will respond to data subject access and deletion requests promptly
- You will notify us immediately of any data breach involving MConnect
5.7 Message Frequency & 24-Hour Window
Users must comply with WhatsApp's 24-hour customer support window and marketing messaging policies:
- Free-form messages may only be sent within the 24-hour customer support window following a user-initiated conversation
- Marketing and promotional messages must use pre-approved message templates
- Users must maintain appropriate message frequency to avoid rate limiting or suspension
6. OutfitFashion — Products & Orders
6.1 Product Information
We strive to display accurate product descriptions, images, and pricing. However, we do not guarantee that colors, sizes, or other details are error-free. We reserve the right to correct any errors and update product information without notice.
6.2 Pricing and Payment
All prices are listed in Indian Rupees (INR) unless otherwise stated. Payment must be received in full before order processing. We accept payments through secured payment gateways. Prices are subject to change without notice.
6.3 Shipping and Delivery
Shipping times and costs vary based on location and product availability. We are not responsible for delays caused by shipping carriers or customs clearance. Risk of loss passes to you upon delivery to the carrier.
6.4 Returns and Exchanges
We accept returns and exchanges within 30 days of delivery for unworn, unwashed items with original tags. Customers are responsible for return shipping costs unless the item is defective or incorrect.
7. Intellectual Property Rights
All Content provided through our Services, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, and software, is the property of NSVPL or its content suppliers and is protected by applicable intellectual property laws.
You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any Content without our prior written consent.
8. User Conduct
You agree not to:
- Use our Services for any unlawful purpose or in violation of these Terms
- Interfere with or disrupt the operation of our Services
- Introduce malware, viruses, or harmful code
- Attempt to gain unauthorized access to our systems
- Harvest or collect user data without consent
- Engage in any activity that could damage our reputation or operations
9. Limitation of Liability
To the maximum extent permitted by applicable law, NSVPL shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of our Services.
Our total liability for any claim arising from these Terms shall not exceed the amount paid by you to us in the 12 months preceding the claim.
10. Disclaimer of Warranties
Our Services are provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.
We do not guarantee that our Services will be uninterrupted, secure, or error-free, or that defects will be corrected.
11. Indemnification
You agree to indemnify, defend, and hold harmless NSVPL, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of or related to your use of our Services, violation of these Terms, or infringement of any third-party rights.
12. Termination
We reserve the right to suspend or terminate your access to our Services at any time, without notice, for any reason including violation of these Terms or applicable laws.
Upon termination, your right to use our Services immediately ceases. Provisions of these Terms that by their nature should survive termination shall survive.
13. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Mathura, Uttar Pradesh.
We encourage you to contact us first to resolve any disputes. If we cannot resolve the issue informally, the dispute shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996.
14. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
15. Entire Agreement
These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and NSVPL regarding your use of our Services.
